Terry is it possible to make the chair usable without a lot of expenditure? Could someone local to you put it into a usable condition and if you no longer want it enable you to sell it on and get your money back that way? The other option is the small claims legal route. A simple form to fill in, a fee to pay and the court does the rest. The person you are claiming against has to pay or justify their actions. If they dispute your claim then there is usually an informal hearing before a court officer and a decision made. If they accept your claim then you get your money back and the court fee. If they don't accept then you are further out of pocket for the court fee but at least you will have tried every avenue. You usually get a fair hearing in the court.

eBay clearly don't have any idea as Paypal has the same policy in this matter with different wording.

What they (eBay) have said is that if the payment was made through Paypal then Paypal should be able to dispute this and claim the money back for you from the seller. If you log in to your Paypal account then you can raise a dispute with Paypal and they should resolve this for you.

Both eBay and Paypal have money back guarantees but eBay seem confident that this doesn't fit under theirs but it does fit under Paypal's.

So Paypal have the same rules as eBay;

Thank you for contacting PayPal regarding PP-004-999-528-265.

Unfortunately, PayPal Purchase Protection does not cover this claim.

Items that are picked up in person, or items where the buyer arranges pick up and delivery, with a shipping company, are not covered by PayPal Purchase Protection.

I best not say what I think, but it is sad that they didn't even look at the evidence and try to seek justice

I have tried to email them but I guess that, if they answer they will say phone up. I really don't want to involve my wife as she knows little about eBay and Paypal and will get aggravated.

I'll just moan here, I'm feed up of going around in circles. Not on face book, twitter, etc.

I was going to make a personnel complaint as he is just showing the same address after telling me that he no longer lives there, but it is all so hard and I guess eBay and Paypal are on the sides of unscrupulous sellers.

I think that maybe Mnda will have to ring them up, like they did to eBay, and find out why as I don't think that I can appeal online.

So much small print and none of it explains why.

The large print says that I will get money and delivery costs back.

Looks like small claims court but I've no idea and it's so hard for disabled people that can't talk to get somewhere and put their case across and get the forms filled in right etc.

The seller told me that he has changed address and no longer lives there, so I don't even know where to send papers etc.

I would defo. appeal the decision, although it is motorised, it is not a vehicle, it is a disability aid.

Terry, I definitely think you should contact your local newspaper about this shoddy treatment (from the unscrupulous seller, eBay and PayPal) and Trading Standards. The item was not fit for purpose.

I guess they have deemed it to be a:- "anything you buy in person" the same sort of reason that eBay said and to try here???

Items like real estate, motorised vehicles (of any kind), custom-made items, industrial machinery (for manufacturing), prepaid cards, or items that violate our policies, anything you buy in person, or money transfers to friends or family.

??? Might be classed as a motorised vehicle. Who knows

Once again I am flabbergasted;

The seller had up to the 12th to state his case, and they stated " PayPal requests more information from the seller to resolve the issue. If the seller doesn't respond within 10 days, we close the case and restore funds to the rightful owner."

He didn't reply at all.

I just got this message from paypal:-

We've completed our review and unfortunately are not able to decide this case in your favor.
We are unable to take any action on this case because it is not covered under PayPal Purchase Protection.

Why! I lodged a dispute, paypal raised it straight to a claim and now they tell me it's not covered.

Crazy!!!
